Objectives
To provide assistance to local educational agencies (LEAs) whose enrollment of homeless students has increased as a result of a natural disaster that occurred in calendar year 2008.

Uses and Use Restrictions
Activities supported with program funds must be allowable under section 723(d) of the McKinney-Vento Homeless Assistance Act. Funds may be used to assist any homeless student in the schools of the LEA, including homeless preschool students, and is not limited to those students who became homeless as a result of a natural disaster. The LEA may use the funds to support future activities, as well as to reimburse itself for costs incurred in carrying out activities during 2008, designed to help homeless students enroll in, attend, or succeed in school.

LEAs that have at least 50 students enrolled in one or more grades kindergarten through grade 12 who became homeless in 2008 as a result of a natural disaster that the President has declared under Title IV of the Robert T. Stafford Disaster Assistance and Emergency Assistance Act of 1974. Beneficiary Eligibility
Students identified as homeless as provided in section 725 of the McKinney-Vento Homeless Education Assistance Act, as amended. Such students include homeless preschool students, and are not limited to those students who became homeless as a result of a natural disaster.

Application Procedure
Eligible LEAs seeking funds under the Homeless Education Disaster Assistance Program funds must submit an electronic application to the Department. The application must include, among other things, data indicating the number of students in kindergarten through grade twelve who became homeless as a result of a natural disaster that occurred in 2008 and required assurances.
Award Procedure
The Department makes one-time grant awards directly to eligible LEAs based on a formula outlined in the notice inviting applications published in the Federal Register.
Deadlines
In order to receive funds made available under Public Law 110-329, eligible LEAs must submit an application to the Department by the deadline established in the notice inviting applications published in the Federal Register.

Formula and Matching Requirements
The Department will award Homeless Education Disaster Assistance program funds directly to eligible LEAs that apply using a formula that is based on the number of students enrolled in one or more grades kindergarten through grade 12 who became homeless as a result of a natural disaster that occurred in 2008. Specifically, the Department will calculate each LEAs award amount based on the quotient obtained by dividing the number of its enrolled students in kindergarten through grade twelve who became homeless as a result of a natural disaster that occurred in 2008 by the total number of such students for all LEAs submitting an application.
Length and Time Phasing of Assistance
Homeless Education Disaster Assistance Program funds become available for obligation upon receipt of those funds by an LEA. Funds remain available for obligation by an LEA for an initial period of availability that expires on September 30, 2009. Under section 421(b) of the General Education Provisions Act, an LEA may carry over any funds that remain unobligated after September 30, 2009 and has an additional 12 months to obligate such funds.

Grantees are subject to the reporting requirements contained in Parts 76 and 80 of the Education Department General Administrative Regulations (EDGAR).
Audits
All grantees are subject to the provisions of the Single Audit Act.

Range and Average of Financial Assistance

The range of funding will depend on how many eligible LEAs apply for these funds.

The Department will publish in the Federal Register a notice inviting invitation, which provides instructions and criteria for LEAs to use in applying for these funds. The Department is also in the process of developing additional guidance and instructions for States to use in applying for these funds.

Criteria for Selecting Proposals
In the notice inviting applications published in the Federal Register, the Department will only award funds to LEAs that have a minimum of 50 students enrolled in kindergarten through grade 12 who became homeless because of a natural disaster that occurred during 2008 are eligible that apply for a grant award. The Department will make grant awards to all eligible LEAs that apply using a formula that is based on the number of students enrolled in kindergarten through grade 12 who became homeless as a result of a natural disaster that occurred in 2008.
