Objectives
To assist in meeting the educational needs of individuals and educational institutions affected by hurricanes in the Gulf of Mexico in calendar year 2005.

Uses and Use Restrictions
Funds may be used to defray expenses related to the restart, reopening, and re-enrollment of students in elementary and secondary schools that serve an area in which a major disaster related to Hurricanes Katrina and Rita was declared. Funds also may be used to provide huricane-related assistance to students and postsecondary institutions under the Federal Supplemental Opportunity Grants, Leveraging Education Assistance Partnerships, and FIPSE programs.
Eligibility Requirements
Applicant Eligibility
State educational agencies (SEAs) in hurricane affected areas. Local educational agencies (LEAs), non-public schools and postsecondary education institutions in hurricane affected areas are subgrantees.
Beneficiary Eligibility
State educational agencies, local educational agencies, postsecondary institutions and students in areas affected by Hurricanes Katrina and Rita will benefit.

Award Procedure
Funds are awarded to State educational agencies which then award subgrants to local educational agencies and non-public schools affected by the hurricanes. Funds also are awarded to the Mississippis Institutes of Higher Learning and the Louisiana Board of Regents for assistance to postsecondary instutions in hurricane affected areas.

Formula and Matching Requirements
Grants will be awarded to State educational agencies in Louisiana, Mississippi, Alabama, and Texas based on the number of students who were enrolled during the 2004-2005 school year in elementary and secondary schools that were closed on September 12, 2005, as a result of Hurricane Katrina, or on October 7, 2005, as a result of Hurricane Rita. Funds also will be awarded in accordance with specific earmarking language in the appropriations act.

Audits
In accordance with the Education Department General Administrative Regulations (EDGAR) in the Appendix to 34 CFR 80, State and local governments that receive financial assistance of $500,000 or more within the State's fiscal year shall have an audit made for that year. State and local governments that receive between $25,000 and $500,000 within the State's fiscal year shall have an audit made in accordance with the Appendix to Part 80, or in accordance with Federal laws and regulations governing the programs in which they participate.

In accordance with the General Education Provisions Act, and the Education Department General Administrative Regulations, States must maintain certain program records for 3 years.
