Objectives

To provide school construction assistance to local educational agencies (LEAs) where the presence of children living on Federal property places a financial burden on the LEAs that educate them (Section 8003, ESEA).

Uses and Use Restrictions

Awards must be used for construction activities, including the preparation of drawings and specifications for school facilities; erecting, building, acquiring, altering, remodeling, repairing, or extending school facilities; and inspecting and supervising the construction of school facilities.

Costs will be determined in accordance with OMB Circular No. A-87 for State and local governments. OMB Circular No. A-87 applies to this program.

 

Application and Award Process

Preapplication Coordination

Preapplication coordination is not applicable. Environmental impact information is not required for this program. This program is excluded from coverage under E.O. 12372.

Application Procedure

This program is excluded from coverage under OMB Circular No. A-102. This program is excluded from coverage under OMB Circular No. A-110. No applications are required. Awards will be determined based on information from Impact Aid Section 8003 applications submitted for FY 2008.

Award Procedure

Funds are awarded according to a statutory formula, based on the number of eligible federally connected children in average daily attendance who are dependents of members of the uniformed services and children living on Indian lands.

Range of Approval/Disapproval Time

The Department expects to obligate funds to SEAs within approximately one month after passage of ARRA.

Appeals

An administrative law hearing is available for any LEA or State adversely affected by any action of the Secretary. The hearing must be requested under the time frame included in the program regulations.

Post Assistance Requirements

Reports

Program reports are not applicable. Cash reports are not applicable. Progress reports are not applicable. The LEA will be required to submit financial documentation to verify the appropriate use of funds. In addition, the LEA will be required to provide a narrative on the outcome of the project and its impact on local employment. ARRA-funded programs will report on how funds under this program are spent and the results of those expenditures. Additional requirements may be included in grant award documents. Performance monitoring is not applicable.

Audits

In accordance with the provisions of OMB Circular No. A-133 (Revised, June 24, 1997), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that receive financial assistance of $300,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $300,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133. In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Nonprofit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have
